NY Supreme Court awards $3 million in cerebral palsy lawsuit

A New York Supreme Court recently awarded $3 million to a teen and his family in a cerebral palsy lawsuit.  The court’s jury found that the obstetrician involved in the teen’s birth was responsible for causing brain damage that led him to develop cerebral palsy.

The teen, 18, was born via C-section.  According to his mother’s claim, her obstetrician called for the C-section 3 to 4 hours too late, and as a result, the child suffered from fetal hypoxia–a situation in which the infant loses oxygen at a rapid pace just before birth.  In order to reduce the risk of hypoxia in infants, it is common procedure for doctors to monitor an infant’s heart rate before delivery.

The doctor argued that there were no signs that the infant was under stress before his birth.  However, evidence showed that the child suffered from fetal hypoxia caused by pressure on the umbilical cord before his birth.

UPMC Hamot and doctors agree to pay $2.2 million in cerebral palsy suit

Recently, two Erie, Pennsylvania doctors and UPMC Hamot agreed to pay a mother $2.2 million in a cerebral palsy lawsuit.

The mother filed the lawsuit in 2008 alleging that defendants’ negligence caused her daughter to develop cerebral palsy.  The girl was born at the hospital in 1998 about two months prematurely.

According to the lawsuit, doctors involved in the child’s delivery should have noticed signs from monitoring devices that the fetus was in distress and suffering from an infection.  The girl now has cognitive impairments, seizures, and language and motor skills delays.

The settlement will be put in a trust and spent on the girl’s medical care throughout the rest of her life.

Michigan family awarded $144 million in cerebral palsy lawsuit

Last week, a Michigan family was awarded $144 million in a cerebral palsy birth injury lawsuit verdict believed to be the largest medical malpractice verdict in the history of the state.

The 3-week long trial was held in Oakland County.  In the case, the parents of a 15-year old girl with cerebral palsy claimed that Beaumont Hospital was responsible for causing her condition.  According to the lawsuit, the girl was born at 11 pounds and doctors should have called for a C-section delivery due to her size.

The 15-year old is quadriplegic due to head and brain injuries she suffered in her delivery.  She also suffered a broken clavicle.

The family’s reward was decided at $144 million because it is the amount it will cost the family to provide 24-hour care for their daughter until 2077, plus lost income.

Mother fights for compensation for son’s birth injury

A single mother in Florida is fighting to receive the $30 million she was awarded in a cerebral palsy medical malpractice lawsuit filed against Lee Memorial Health System in Lee County, Florida.

A jury granted the $30 million award in 2007 due to the negligence that occurred at the Lee Memorial Health System and resulted in the woman’s son developing severe cerebral palsy.  The boy, now 14-years old, uses a wheelchair and has difficulty speaking and writing.

The case went through an appeals process and was upheld in 2009.  Despite the verdict, the mother has yet to receive the compensation she was awarded and needs the money to take care of her son.

Twice, a claims bill has been filed with the Florida legislature to approve the verdict.  However, the state’s $200,000 cap on liability for government institutions has delayed the payment.

Connecticut family awarded $58 million in cerebral palsy suit

A Connecticut jury recently awarded a family the largest verdict in the state’s history in a birth injury lawsuit.  The lawsuit was filed by the parents of a young boy who developed cerebral palsy as a result of a delayed C-section.

The boy’s mother went into labor in February 2003.  Records showed that the mother’s amniotic fluid dropped significantly before she was scheduled to deliver.  However, doctors did not order an emergency C-section until a few days later.  The delayed C-section resulted in hypoxia, brain damage, and cerebral palsy in the mother’s infant son.

The jury awarded the family $58 million.  $8 million of the verdict was given for future medical expenses related to the boy’s cerebral palsy.  $50 million of the verdict was given for emotion and physical trauma.

$13M Settlement in UK Cerebral Palsy Birth Injury Lawsuit

A the family of a boy in England has been awarded $13 million in a birth injury lawsuit.

According to court documents, Nathan Humphries was left with cerebral palsy and epilepsy after midwives at North Straffordshire Hospital failed to react to his mother Beverly’s high blood pressure during his delivery in 1998. Beverly Humphries suffered an eclamptic fit, leaving Nathan starved for oxygen in the womb.

After a 12-year battle, the University Hospital of North Staffordshire Trust admitted liability. “There were a lot of good midwives, but there was one who we blame and always will,” Beverley Humphries said. “I still feel angry that mistakes that should never have happened led to Nathan suffering a life-long disability. I am relieved that the settlement will mean that Nathan can be cared for in the way he needs, for the rest of his life.”

Cerebral Palsy Birth Injury Lawsuit Filed Against PA Hospital

Memorial Hospital in Pennsylvania has been named in a birth injury lawsuit filed by the parents of a young girl who suffers from cerebral palsy.

According to court documents, Jenifer and Lance Schneider claim their daughter, Sophia, was born with hypoxic brain injury due to a lack of oxygen at birth. The lawsuit, filed last week in St. Clair County Circuit Court, names Dr. Michael E. Herrmann and Memorial Hospital as defendants. The Schneiders claim Sophia Schneider has developed cerebral palsy, causing her to lose her capacity to enjoy a normal life. The complaint also claims Sophia has suffered sustained disfigurement, disability, and pain and suffering.

The Schneiders are asking the court for more than $150,000 in damages, in addition to legal fees.

Cerebral palsy is a term used to describe a number of chronic conditions affecting body movements and msucle coordination. Children who suffer from cerebral palsy may not be able to walk, talk, eat, or interact in the same way as other children. $19.2M Verdict in Cerebral Palsy Birth Injury Lawsuit

A jury in Florida returned a $19.2 million verdict in a cerebral palsy birth injury lawsuit filed by the family of a girl who was overdosed on nutrients during birth.

According to the lawsuit, Kiarra Smith was given a dose of nutrients 100 times more powerful than the doctor had prescribed when she was born three months premature at HealthPark Medical Center in 2007. The medication mistake by hospital staff caused Smith to go into cardiac arrest. She is now blind and suffers from cerebral palsy.

Cerebral palsy can be caused by a brain injury during birth. If an infant is deprived of oxygen, it can result in irreversible brain damage that leaves the child with developmental problems and life long injuries such as cerebral palsy.

The jury awarded $19.2 million in damages to Smith’s family. Smith will be in a wheelchair and require care for the rest of her life as a result of the disability.

$2.1M Settlement in Cerebral Palsy Birth Injury Lawsuit

A London hospital has agreed to pay a $2,157,975 settlement in a birth injury lawsuit.

According to court documents, obstetrician Michael Gannon and Mullingar General Hospital have admitted negligence in the circumstances surrounding the birth of 4 year-old Luke Miggin. Based on reports, Gannon failed to notice a decrease in Miggin’s heart rate on a cardiotocographic trace. The doctor also failed to consider an abnormal CTG trace and failed to carry out a Cesarean section, the lawsuit says.

Miggin was born by forceps delivery, but required artificial resuscitation. Miggin was later diagnosed with cerebral palsy, a non-progressive motor condition that causes physical disability in human development. The child is now confined to a wheelchair and requires 24-hour care.

The $2,157,975 settlement was announced Tuesday, and will also include an additional $300,000 to go to Luke’s special accommodation needs. It will be reconsidered on the basis of a forthcoming judgement regarding how the court should deal with Miggin’s housing requirements.

Birth Injury Lawsuit Filed Against Florida Hospital

A couple in Florida have filed a birth injury lawsuit against a Bartow hospital, claiming medical errors caused their daughter’s cerebral palsy.

The lawsuit names Lakeland Regional Medical Center, Central Florida Health Care, and two nurse practitioners as defendants. Filed by Fiona and Stanley Brown, the lawsuit claims Mrs. Brown was receiving prenatal care at the medical center. Brown went in for a regular check-up on September 28, 2005 with “signs and symptoms of high blood pressure,” the lawsuit says. It is believed she was evaluated by a nurse midwife there who told her to go to LRMC.

According to the lawsuit, when Brown arrived at the hospital, the fetal monitor strip indicated a decrease in fetal heart rate. Brown was told she need an emergency Cesarean section, but delivered vaginally before it could be performed. The lawsuit contends negligence by the defendants caused Brown’s daughter, Destiny, to suffer a brain injury and subsequent neurological damage.
