State-diverted funds to be transferred back to malpractice account

A Pennsylvania court ordered the state to return nearly $800 million dollars in diverted funds back to an “MCare” account designed to help doctors pay for their medical malpractice insurance. The surplus funds were diverted for use in other areas, but a Commonwealth Court panel voted 4-1 in favor of returning the money back to the malpractice account.

Infant’s Arm Broken During Delivery

A hospital in Malaysia is facing a lawsuit from a womanalleging a doctor’s negligence during delivery resulted in her newborn’s armbeing broken. Sultan Abdul Halim Hospital maintains that the injury was not dueto the negligence of the staff.

Dr. Harif Fadzilah of the hospital’s ComplaintsInvestigation Committee said “Faizah had difficulty during delivery as her babyhad shoulder dystocia, where the baby’s shoulders got stuck during the process…”The doctor who handled the delivery said he was faced with a critical situationwhere he had to take emergency measures to take the infant out or else it couldsuffer brain damage or die from birth asphyxia.

The baby’s fractured left arm should heal in a few weeks.
