MA family awarded $7 million in suit against hospital staff

A family from Massachusetts was recently awarded $7 million in a birth injury lawsuit filed against the staff at Beth Israel Deaconess Medical Center who treated their newborn daughter. According to the lawsuit, the girl was born two months premature in June 2004.

After her birth, the newborn immediately began having problems and was put in the hospital’s neonatal intensive care unit (NICU). The newborn’s condition became worse and worse, yet the staff caring for her failed to diagnose that her bowels had been perforated. When the problem was diagnosed, doctors attempted to stabilize her intestinal tissues, but the surgery was not successful, and the girl passed away.

A jury determined that the newborn’s doctor and nurse practitioner were negligent in their care of the girl. Both parents were awarded $3.5 million. An attorney in the case stated, “By all accounts [the newborn] should have progressed on just like her sister and should have gone on to live a normal life.”

Last week, a jury in Nebraska awarded $1.8 million to the family of a 3-year old girl who suffered permanent and paralyzing birth injuries.

The child was injured during her delivery in June 2008 when doctors used a vacuum to help the newborn out of the birth canal.  In the process, the child’s shoulder became lodged behind her mother’s pelvic bone and doctors pulled on her head to help her out.

According to the lawsuit, the vacuum delivery was unnecessary and the child’s nerve damage was caused by doctors pulling on her head.  The nerve and brain damage caused the girl’s left arm to be paralyzed.

The jury awarded the girl $600,000 for her pain and suffering and $1.2 million for past and future medical expenses.

Georgia mother files internal birth injury suit

A mother from Dawnville, Georgia recently filed a lawsuit against the doctors, staff, and hospital involved in her 18-month old daughter’s delivery.  The lawsuit was filed in the Hamilton County Circuit Court in Tennessee.

The mother gave birth in Chattanooga.  Before the delivery, doctors noticed that the girl was suffering from bowel enlargement and obstruction and expressed concern over performing a vaginal delivery.  Still, staff at the hospital did not order a C-section and the mother gave birth vaginally.

The infant suffered internal birth injuries during her delivery, requiring surgery and the removal of some of her intestines.  Now, the girl survives using a feeding tube.

Internal birth injuries are often the most difficult type of birth injury for mothers and doctors because they can easily go unnoticed and untreated.  Furthermore, if an internal birth injury does go unrecognized for too long, a newborn could suffer serious and permanent injuries.
