Wisconsin mother wins $18.2 million in asphyxia lawsuit

A Wisconsin mother was recently awarded $18.2 million in a birth injury lawsuit filed against the federally funded Sinai-Samaritan Hospital in Milwaukee. The lawsuit states that the hospital’s “horrific care” caused the woman’s now 10-year old daughter to suffer permanent brain damage.

According to court documents, the mother went to the hospital to deliver her daughter 10 years ago.  She claims that hospital officials ignored her risks of complication as stated in pre-registration notes including gestational diabetes and a history of delivering babies of above-average in weight.

A family practice doctor and midwifes were assigned to deliver the baby.  During labor, the mother says she was left for more than 12 hours unattended despite being dilated.  In addition, during delivery, the baby was lodged in the birth canal for over 20 minutes causing the infant to be deprived of oxygen and suffer severe brain injuries.

U.S. pays $2.3 million for child born at Naval Medical Center

This week, the U.S. government agreed to pay $2.3 million to settle an asphyxia birth injury lawsuit with the family of a child born at the Portsmouth Naval Medical Center.

The Holweger family of Virginia Beach, Virginia filed suit against the Justice Department after their daughter suffered asphyxia during delivery at the hospital.  Michelle Holweger went to Portsmouth Naval Medical Center in 2006 at 35 weeks pregnant.  Despite several signs that the fetus was under stress, doctors failed to call for a cesarean section until 2 and a half hour after being admitted.

During the delivery, doctors realized that the placenta had become detached from the uterine wall causing asphyxia.  Asphyxia occurs when there is a lack of oxygen to the fetus.  The infant was born with a slow heart rate, respiratory failure and permanent neurological injuries and cerebral palsy.
