Erb’s Palsy

Erb’s palsy is a common birth injury caused by damage to theupper group of nerves in a newborn’s arm.

The most common cause of Erb’s palsy is shoulder injuryduring birth. If the infant’s shoulders and head are positioned into an awkwardposition in the birth canal, damage can be done to the nerves in the arm. Theeffects of Erb’s Palsy can include loss of sensation in the limb, paralysis andatrophy of the muscles, and extremely stunted growth of the arms.

London Woman Awarded $4.9M in Birth Injury Verdict

A woman in England has received a $4.9 million compensationpackage for birth injuries she suffered thirty-seven years ago.

Maureen and Michael Walker have given constant care to theirdaughter Helen since her very prolonged delivery at the Birmingham Women’s Hospitalin July of 1972. According to Margaret Bowron, barrister for the Walkers, thecouple could just barely afford to support their daughter when they found outthey had a claim over a decade ago when proceedings began.

Judge Justice Owen approved the multi-million dollar awardagainst the West Midlands Strategic Health Authority. Counsel for the hospital,Terence Coghlan, said the authority greatly regretted the negligence which wasadmitted and wished the family well.

Helen Walker will receive lifelong periodic paymentsamounting to $4.9 million.

Norfolk Girl Wins Birth Injury Settlement

A 14 year-old girl in Norfolk, England, has won amulti-million dollar compensation payout after being severly disabled at birth.

Tahlia Jade Downes was deprived of oxygen during herdelivery at the Norfolk and Norwich Hospital. Downes, through her mother Dawn, suedthe hospital managers claiming a Caesarean should have been preformed.

The hospital denied that staff had caused any injury butagreed to a settlement that is expected to run in to several millions.

The High Court of London heard that Tahlia had sufferedpermanent brain damage which led to severe mental and physical disabilities andalso affected her vision.

The hospital has agreed that Downes should be compensated onthe basis of 70% of a full valuation of her claim.

Jury Awards $4.4M in Birth Injury Case

A South Carolina jury has awarded the parents of a child whosuffered a brain injury at birth $4.4 million in a medical malpractice lawsuit.

The Robin Wilson and her husband Brice, of Fort Lawn, SouthCarolina, filed a medical malpractice lawsuit against Piedmont Hospital.Wilson, born November 18, 2003, developed Cerebral Palsy due to a severe braininjury caused by oxygen deprivation. The jury found the hospital negligent forassigning a nurse trainee to monitor Wilson. The nurse misread fetal heartmonitoring data, which showed the baby was in distress and needed emergencyintervention.

Ken Suggs, the Wilson’s attorney, said of the case “Whenmedical professionals fail to meet reasonable standards of care they need to beheld accountable, and the jury agreed with that.”

$43.5M Awarded in Birth Injury Verdict

The New York Supreme Court has awarded one of the largestmalpractice verdicts in the history of the state. The court awarded $43.5million to a woman who sued the Bellevue Maternity Hospital for sever braindamage she suffered during her birth.

The 24 year-old Tiffany Busone suffers from cerebral palsyas a result of a lack of oxygen and failure to properly resuscitate her duringbirth. The lawsuit claimed that as a newborn she was deprived of oxygen for10-15 minutes. Busone now uses a wheelchair and lacks motor skills due to thebrain damage.

The payments break down into $20 million to pay for homehealth aides, $15 million for future pain and suffering, and $6 million forpast pain and suffering and the balance for medical expenses and loss ofearnings.

Attorney for Busone, Stephen Coffey, called the verdict “astounding…This verdict supports what she always thought… that Bellevue didn’t do whatthey were supposed to do.”

Busone’s mother originally filed the lawsuit in 1984.
