NJ hospital sued for brain damage birth injury

The mother of a boy that suffered brain damage during his delivery at the Bayonne Medical Center filed suit against the hospital.  The now 5-year old boy needs 24 hour care.

The mother went to the hospital in labor on August 14, 2005 and tests did not show that the baby was experiencing any stress.  Approximately 10 hours later, the child experienced a sudden drop in heart rate because the umbilical cord was being compressed.  As a result, the child was deprived of oxygen in the womb.

The hospital’s staff was found to be negligent for waiting for half an hour after realizing the child was being deprived of oxygen before ordering an emergency C-section.  The boy’s family was awarded $8.5 million for medical expenses and emotional damages in the lawsuit.

Mild traumatic brain injuries explained

While many people are familiar with the term traumatic brain injury, fewer are aware of the difference between a TBI and a mild traumatic brain injury.  Doctors categorize brain injuries as MTBIs when the damage is not life-threatening.  In addition, MTBIs generally do not require immediate surgery.

Despite being labeled “mild”, MTBIs can involve very serious, irreversible, and life-long brain damage.  This type of head injury is caused by acceleration or deceleration of forces affecting the head and brain, such as whiplash, or blunt trauma.  One cause of MTBIs is birth injuries.

Approximately 75 percent of brain injuries in the United States are identified as MTBIs.  Symptoms of brain trauma include amnesia, loss of consciousness, confusion, and neurological dysfunctions like seizures, dizziness, and headaches.

Ohio hospitals pays $4.3 million for brain injury

Mercy Medical Center in Canton, Ohio will pay $4.3 million to the family of a young girl who suffered brain damage during her delivery in 2008.  Last year, the girl’s parents filed the hospital negligence and birth injury lawsuit against the hospital on behalf of their now 3-year old daughter.  The court was able to make a decision through mediation.

The girl’s mother went to the hospital on March 13, 2008 to deliver the baby.  Nurses administered Pitocin to induce labor but failed to notice that the fetus was under stress.  The mother was experiencing hyperstimulation in her uterus and the baby was resistant to labor.  The next morning, monitors revealed that the child had an abnormally and dangerously low heart rate.

Doctors decided to perform a C-section shortly after learning of the girl’s heart rate.  The girl was born with serious brain damage and had to be resuscitated after the surgery.

Neurosurgeon testifies brain damage is birth injury

Yesterday, a Washington D.C. neurosurgeon testified to an Iowa court that a 6-week old infant’s brain damage is the result of a birth injury, not abuse.  Authorities had previously believed that bleeding in the infant’s brain was caused by physical abuse.

Dr. Ronald Uscinski found when looking at baby Ethan’s medical records that bleeding in the brain was too far deep to have been caused by abuse.  ”It verified to me that this is a birth injury,” said Uscinski to Polk County jurors.  Furthermore, he denied the possibility of shaken baby syndrome stating that there was “no evidence of any kind of medical trauma.”

The doctor testified in a trial against the baby’s father who had been suspected of abuse.  The surgeon also noted that the injuries were most likely birth injuries because if the infant was shaken it would also have suffered neck or spinal injuries.

Chicago hospital & physician pay $6.5 million in brain damage suit

A Chicago hospital and physician recently settled a brain damage birth injury lawsuit and will pay $6.5 million to the family of a girl that suffered brain damage at birth more than 10 years ago.

Denise Cisneros, the mother of the girl, filed suit against Advocate Lutheran General Hospital and her physician after they failed to perform a c-section in a timely manner.  As a result, Cisneros’ daughter suffered brain damage and now lives with cerebral palsy.  In addition, the now 10-year old girl has seizures and needs assistance walking, dressing herself and bathing.

The settlement between the family and the hospital was achieved in mediations and approved in a Cook County, Illinois court.
