Couple Sues Hospital for Birth ‘Distress’

Posted on March 30th, 2010 No Comments

A couple in Somerton, England are seeking, what amounts to, more than $450,000 from the hospital where their son was born, after a “horrifying and distressing” delivery.

Frances and Mark Sloman filed a lawsuit in Baltonsborough High Court seeking damages for personal injuries and trauma suffered through the “negligence of staff” during the birth of their second child on June 5, 2007. The couple claims there was an atmosphere of panic in the delivery room when doctors performed a caesarean section, with senior doctor Vinita Raheja allegedly shouting she “could not find the baby.”

Though their son was delivered safely, 37 year-old Frances Sloman claims she sustained physical injuries as the result of negligent care during delivery. Mark Sloman, who was present in the delivery room, claims in court documents that he suffered “psychiatric injury in the event of witnessing horrifying and distressing events concerning his wife and unborn child.”

28,000 birth injuries occur annually

Posted on March 26th, 2010 No Comments

According to a recent study, some 28,000 birth injuries occur annually in the United States, some so severe that they may continue to affect the injured child’s quality of life for years or even decades to come.

The study concluded that birth injuries occur in about 7 out of 1,000 births. While this may seem small, about 76 injuries are recorded every day. Birth injuries are defined as any injuries in the birthing process, and are often caused by doctor error. While some are small and can resolve themselves in a matter of days, others are severe and can result in life-long disabilities, deformities, and illnesses.

If your child was injured in the birthing process, you deserve financial compensation for this injustice. Your child deserves the money. Contact the Philadelphia birth injury attorneys of Lowenthal & Abrams, P.C., by calling 215-238-1130 to learn what we can do for you.

Gov. Rendell: Healthcare should cover birth injuries

Posted on March 26th, 2010 No Comments

Pennsylvania Governor Edward G. Rendell has sent a letter to state Attorney General Tom Corbett asking him to drop his challenge of President Obama’s healthcare plan, partially on the basis that it will help parents care for children who suffer long-term disability because of birth injuries.

According to Gov. Rendell, the bill will help Pennsylvania families afford the care for children who have been injured at birth. He argues that many families often have difficult affording necessary healthcare for their special-needs children. Opponents disagree, saying that the healthcare package is too expensive and creates a state-run healthcare industry.

If your child suffers from a disability stemming from an injury incurred at birth, the Philadelphia birth injury attorneys of Lowenthal & Abrams, P.C., may be able to help you get the compensation you and your child need. Contact us today by calling 215-238-1130.

Vacuum Extraction and Birth Injury

Posted on March 11th, 2010 No Comments

During the birth process, an infant may suffer a physical injury that is simply the result of being born; other times birth injuries are caused by a negligent medical worker.

The size of an infant or it's position during labor can cause a difficult birth. Naturally occurring conditions such as a breech delivery or premature birth can prolong labor and complicate delivery. Appropriate response by medical workers can overcome these obstacles; however, some techniques, if not executed properly, can exacerbate these issues and result in injury to the infant.

Vacuum extraction is one technique often employed by doctors to expedite the delivery process. The incorrect use or application of vacuum extraction, however, can result in serious injury to the newborn.  Caput Succedaneum is a common birth injury characterized by severe swelling of the soft tissue on a newborn's scalp caused by friction in the birth canal. Some infants may even develop serious bruising in the swollen areas. Vacuum extraction exacerbates this condition and in some cases may cause swelling that would otherwise not have occurred.

If your child has been injured by a negligent medical worker, finding an experienced and trustworthy attorney is vital in securing a positive outcome in your case. Please contact a Philadelphia birth injury lawyer of Lowenthal & Abrams, P.C. by calling 215-238-1130.

Couple Demand Inquiry in Child’s Death

Posted on March 5th, 2010 No Comments

A couple in scotland are demanding an inquiry into the death of their infant daughter during birth.

Psychologist Dr. Craig Campbell and his wife Beatrix conceived through IVF treatment nine months ago. When Beatrix went into labor earlier this month she was taken to Edinburgh Royal Infirmary's Simpson Centre for Reproductive Health. During delivery requests for a Caesarean were ignored by medical staff.

A junior doctor opted to use forceps to correct the position of the infant. Clamping the metal tool around the skull, the doctor rotated the child's head while the body remained in place. The infant suffered a severe spinal injury during the procedure and died shortly after.

Beatrix said "to walk out of a hospital that had destroyed my strong, healthy child was just devastating."

Common Forceps Injuries

Posted on March 4th, 2010 No Comments

Forceps are tools that have been used to assist in childbirth since the 1600's.

Short forceps, used in the United Kingdom and the United States, are applied to the fetal head inside the birth canal. The blades of the instrument are locked into place around the skull and the fetal head is rotated to provide a minimal amount of traction during delivery.

While forceps can be used to avoid caesarean delivery, and take less time, there are a number of birth injuries associated with the tool. An infant may sustain temporary or permanent nerve damage if forceps are applied in the wrong location, or with too much pressure. Facial bruising on the newborn is also common. Skull fractures are not rare either.

Forceps are a legitimate medical tool; in the hands of an experienced operator, the risk of injury is no higher than with natural intervention-free vaginal delivery. In the wrong hands, however, the instrument can cause serious harm to an infant and its mother.
