Virginia Birth-Injury Board Investigates Fraud

The Virginia birth-injury board is investigating charges of embezzlement in one of its key employees.  A forensic auditor has been engaged to track how much money was stolen.

According to reports, the suspect has embezzled about $800,000 from the program over at least three years.  The man was fired in March after discrepencies emerged in accounts for over 100 children with birth injuries, many of them with severe injuries.  It is yet to be seen how much money has been taken from the program, and by extension, from disabled children and teens.

British Man Awarded $2.4M for Birth Injury

A man in England has been awarded $2.4 million for an injuryhe suffered at birth.

Belinda Boustead sued the Carlisle City Maternity Hospitalover the botched birth of her son Simon. The lawsuit alleged that delays to hisbirth by medics at the hospital staved Simon of oxygen, causing him to suffer abrain injury which left him with a lifetime disability.

The Manchester High Court awarded Simon a $2.4 million lumpsum as well as annually payouts throughout his life.

In the hours before Simon was delivered, he showed clearsigns of fetal distress. The oxygen starvation caused by doctors delay ofdelivery was directly linked to a catastrophic hemorrhage Simon suffered sometime after his traumatic delivery.

Norfolk Girl Wins Birth Injury Settlement

A 14 year-old girl in Norfolk, England, has won amulti-million dollar compensation payout after being severly disabled at birth.

Tahlia Jade Downes was deprived of oxygen during herdelivery at the Norfolk and Norwich Hospital. Downes, through her mother Dawn, suedthe hospital managers claiming a Caesarean should have been preformed.

The hospital denied that staff had caused any injury butagreed to a settlement that is expected to run in to several millions.

The High Court of London heard that Tahlia had sufferedpermanent brain damage which led to severe mental and physical disabilities andalso affected her vision.

The hospital has agreed that Downes should be compensated onthe basis of 70% of a full valuation of her claim.

$449K Awarded in Birth Injury Lawsuit

A boy in England who suffered a disability in his right armdue to an admitted medical mistake during his birth has been awarded $449,290in compensation by London’s High Court.

Grant Hembry suffered shoulder dystocia, a condition whichcauses nerve damage, when he was delivered at Derriford Hospital on April 11,1998. Hembry’s shoulders became stuck during delivery, and it was alleged that medicalstaff did not employ standard manoeuvres to overcome the problem. PlymouthHospitals NHS Trust, which runs Derriford Hospital, admitted negligence andagreed to pay Grant damages.

Hembry suffers from Erb’s Palsy as a result of the mistake.He has lost function of his right shoulder, arm and hand.

Grant’s lawyer, Christopher Kemp, said that Hembry hadundergone three operations on his arm, and although he had made a good recoveryeach time, he still had restricted use of his arm.

Second Settlement Reached in Birth Injury Case

A woman from Tipperary who filed a medical malpracticelawsuit on behalf of her daughter, has settled her own action against thehospital.

Clodagh Brett filed suit over a birth injury her daughtersuffered at St. Luke’s General Hospital in Kilkenny, her daughter was awardedalmost $6 million dollars earlier this month. The settlement of Brett’spersonal action against the hospital has not been made public.

She claimed that at the time of her daughter’s birth she wasa victim of medical malpractice. Brett told the court that a Caesarean sectionwas only carried out after she had been left in horrific pain of a prolongedperiod of time.

Soldier Acquitted of Son’s Death, Birth Injury to Blame

A soldier accused of causing his son’s death has been foundnot guilty by a court-martial panel at Fort Rucker.

Spec. Dedrick Fischer Sr. was found not guilty ofinvoluntary manslaughter and not guilty of the lesser charges of negligenthomicide and battery of a child under the age of 12.

The panel was made up of six people who are upper ranking commissionedofficers and enlisted soldiers station at Fort Rucker.

Fisher was charged with manslaughter after his son, DedrickJr., died at the Dale Medical Center on February 2nd of injuriessustained three months earlier. Fischer was accused of shaking his son andcausing several brain bleeds and retinal hemorrhages that resulted in hisdeath.

A doctor was brought in as an expert witness for thedefense. Dr. Ronald H. Uscinski testified that he did not “believe that thefindings on the diagnostic studies and histories indicate the child was injuredon the day in question.”

He said the infant died from a birth-related injury. Thebrain injury the infant sustained, Uscinski explained, manifested itself theday that Fischer went under investigation for abusing his son.
