Irish Court Approves $6.6M Birth Injury Award

The High Court in Ireland has approved a €4.5 million ($6.6million) settlement in the case of a six-year-old girl for brain injuriessuffered at birth.

Clodagh Brett of Tipperary, Ireland sued on behalf of herdaughter Keri Brett who has cerebral palsy and will need constant care for therest of her life.

The High Court heard that St. Luke’s hospital in Kilkennyhad denied liability until July 2007 even though an internal investigationthree years earlier had identified that the birth had been mismanaged. Lawyersfor Brett argued that the hospital fell far below a reasonable standard and wasin the category of incompetent.

The hospital has issued an unreserved apology to the Brettfamily in addition to the settlement. The Brett’s said they will now be able tobuild a wheelchair accessible home for their daughter.

Jury Awards $4.4M in Birth Injury Case

A South Carolina jury has awarded the parents of a child whosuffered a brain injury at birth $4.4 million in a medical malpractice lawsuit.

The Robin Wilson and her husband Brice, of Fort Lawn, SouthCarolina, filed a medical malpractice lawsuit against Piedmont Hospital.Wilson, born November 18, 2003, developed Cerebral Palsy due to a severe braininjury caused by oxygen deprivation. The jury found the hospital negligent forassigning a nurse trainee to monitor Wilson. The nurse misread fetal heartmonitoring data, which showed the baby was in distress and needed emergencyintervention.

Ken Suggs, the Wilson’s attorney, said of the case “Whenmedical professionals fail to meet reasonable standards of care they need to beheld accountable, and the jury agreed with that.”

Cerebral Palsy is Common Result of Birth Injuries

A birth injury is trauma to a child that occurs duringdelivery. The most common injuries are a result of pressure in the birth canal.

Cerebral palsy is one of the more common results of birth injuries. CPis a chronic disorder that is caused by trauma to the brain during birth orshortly thereafter. The condition causes loss of movement and other nervefunctions.

Cerebral palsy is not what doctors call a progressivecondition, this means that the symptoms do not worsen or improve over time. $43.5M Awarded in Birth Injury Verdict

The New York Supreme Court has awarded one of the largestmalpractice verdicts in the history of the state. The court awarded $43.5million to a woman who sued the Bellevue Maternity Hospital for sever braindamage she suffered during her birth.

The 24 year-old Tiffany Busone suffers from cerebral palsyas a result of a lack of oxygen and failure to properly resuscitate her duringbirth. The lawsuit claimed that as a newborn she was deprived of oxygen for10-15 minutes. Busone now uses a wheelchair and lacks motor skills due to thebrain damage.

The payments break down into $20 million to pay for homehealth aides, $15 million for future pain and suffering, and $6 million forpast pain and suffering and the balance for medical expenses and loss ofearnings.

Attorney for Busone, Stephen Coffey, called the verdict “astounding…This verdict supports what she always thought… that Bellevue didn’t do whatthey were supposed to do.”

Busone’s mother originally filed the lawsuit in 1984.

UC Davis Pays $6M in Malpractice Settlement

A boy who was injured when he was born in the UC DavisMedical Center has been awarded $5.75 million. Cannon Hoops got $1.75 millionup front and another $4 million in annuities to pay for his medical and assistivecare as well as future lost earnings over the rest of his life.

Hoops’ parents were also awarded $250,000 to waive anyfuture wrongful death claims in the event their son does not survive.

Cannon hoops suffered “severe and permanent” neurologicalinjuries as a result of lack of oxygen to his brain during his birth. Thelawyer for the Hoop’s family explained “The baby came out blue, not breathing,and it took a while for the physicians to recognize there was a problem.”According to the Hoops’ attorney, if the doctors had delivered the child byCaesarean section it “would’ve prevented the whole problem.”

Infant’s Arm Broken During Delivery

A hospital in Malaysia is facing a lawsuit from a womanalleging a doctor’s negligence during delivery resulted in her newborn’s armbeing broken. Sultan Abdul Halim Hospital maintains that the injury was not dueto the negligence of the staff.

Dr. Harif Fadzilah of the hospital’s ComplaintsInvestigation Committee said “Faizah had difficulty during delivery as her babyhad shoulder dystocia, where the baby’s shoulders got stuck during the process…”The doctor who handled the delivery said he was faced with a critical situationwhere he had to take emergency measures to take the infant out or else it couldsuffer brain damage or die from birth asphyxia.

The baby’s fractured left arm should heal in a few weeks.
