In Maryland, the highest court has come to a decision that changes informed consent law. Doctors now must not only inform patients of potential risks, but must also inform them of benefits of procedures.

This ruling spurs from an incident in which a woman could have had an emergency C section that would likely have produced a healthy child. Instead, the doctors went ahead with a vaginal birth, and the child was born with cerebral palsy. Had the woman known the benefits, she likely would have opted for the surgery.

Woman’s Death Brings up Questions about IVF

In December 2006, a 66 year old woman gave birth to twins. Recently, she died of an undisclosed cause, leaving behind her nearly 3 year old twins. Because of this situation, questions have arisen about in vitro fertilization or IVF.

The woman lied to doctors about her age to have the procedure done. She required hormone therapy to allow her uterus to support pregancy after 18 years of menopause. VBACs on the Decline

These days, only 8% of American women have VBACs, or vaginal birth after c-section, compared with a high of 30% in the 1990s. This decline is coupled with an increase in the number of c-sections.

While not every woman can undergo a VBAC, it is a good decision for some. Some of the benefits include a shorter hospital stay and lower risk of infection. It also avoids c-section which can cause terrible injury to the infant.

$31 M Verdict in Cerebral Palsy Case

In Ohio, a jury has awarded the parents of a child with cerebral palsy $31 million in damages. The boy, now 8, was born December 11, 2000 at Miami Valley Hospital in Dayton, Ohio.

During his delivery, the boy was deprived of oxygen for 18 to 20 minutes. As a result, he suffered brain damage that led to severe cerebral palsy. He is unable to speak or walk and requires permanent care.

Birth Injury Settlement 32 Years after Birth

In the UK, a 32 year old woman who suffered a birth injury had a settlement approved on Tuesday. The judge approved a 3 million pound settlement between the woman and the company that runs Wycombe General Hospital where she was born.

During labor on January 1, 1977, the then infant's heart rate dropped suddenly and she had to be delivered through caesarean section. A lack of oxygen to her brain caused her to develop cerebral palsy which, among other things, has kept her from walking all her life.

Shackling During Childbirth

Cancer Survivors at Risk for Birth Complications

Survivors of childhood cancer have been shown to be at a higher risk of having birth complications. The study took data from 40 women who had had cancer in their childhoods and was compared to a control group of 9,000 women.

The women who survived cancer and had been through radiation  therapy had more premature births and postpartum hemorrhaging. Knowing this, doctors should pay close attention to women in this category to avoid birth injuries.
